Legislative Committee Minutes – August 10, 2015

Chairman Boland called the meeting to order 3:00 PM

PUBLIC COMMENT PERIOD

There being no citizens who wished to address the Committee, Chairman Boland closed the Public Comment Period.

ADOPT:

Commissioner Cason made a motion seconded by Commissioner Booker to adopt the minutes from the June 30, 2015 meeting. Motion carried 3-0-0.

DISCUSSION:

Charles Dorminy handed out the revised legislation act. It was discussed that ‘Joint’ needs to be added in Section 2.  The Quorum was discussed and all agreed that 4 Commissioners will make up a quorum.

There was discussion on Section 7 (18) – To solicit and accept donations, contributions and gifts of money from any source including, but not limited to, current customers. There was discussion regarding various account options like Round up, 501c3 tax deduction or an interest baring account.  Disbursement could be tracked and it will allow a third party to administer the account.

Enforcement and fines were discussed. It was stated that JWSC has the authority to enforce and file a lien when necessary.  The minimum penalties are set by the City and County ordinances payable to the utility.

It was stated that water/sewer providers already have Eminent Domain pursuant to statute. However, the legislation needs to clarify because of Operation Agreement language.

There was discussion regarding the 5% Owners Contingency clause added to contracts which will be handled on a case by case basis. It is recommended in the bid packets that JWSC encourages the contractor to use local participating vendors.  Therefore, no provision in this regard is needed in legislation.

There being no other business to bring before the Committee, the Chairman adjourned the meeting.
